The Rev It Up! Sweepstakes (“Sweepstakes”) begins on March 1, 2009 and concludes on July 15, 2009 (the “Sweepstakes Entry Period”). ELIGIBILITY: Sweepstakes is open to legal residents of the United States (excluding residents of Alaska, Arizona, Delaware, Hawaii, Massachusetts, New Jersey, New York, Puerto Rico, Rhode Island, U.S. possessions and territories), age 18 and older at time of entry. Void in Alaska, Arizona, Delaware, Hawaii, Massachusetts, New Jersey, New York, Puerto Rico, Rhode Island, U.S. possessions and territories and where prohibited by law. Employees of Black Cat Marketing USA (the “Sponsor”), its parent company, subsidiaries, affiliates, retailers, dealers, advertising and promotion agencies, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each such employee, whether or not related, are not eligible to enter or win. Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. HOW TO ENTER: There are two (2) methods of entry. Method #1: Complete an Official Entry Form (in its entirety), while supplies last, and deposit it in the Sweepstakes Entry Box during the Sweepstakes Entry Period. Official Entry forms can be found at a participating retailer. Visit www.BlackCatFireworks.com to locate a participating retailer. Method #2: To enter via US mail, hand print your name, address, zip code, date of birth, phone number and e-mail address (if any) on a postcard and mail to: Rev It Up Sweepstakes, P.O. Box 9224, Medford, NY 11763-9224.Entries mechanically reproduced or generated by script, macro or by automated means are not eligible. All entries become Sponsor's property and will not be returned or acknowledged. Released Parties (as defined below) are not responsible for lost, late, damaged, misdirected, incomplete, illegible, undelivered, delayed, inaccurate or postage due mail/entries. Neither the Sponsor nor Released Parties assume responsibility for third parties’ failure to act in accordance with Sponsor’s instructions pertaining to the implementation of the Sweepstakes. Mail-in entries must be postmarked between March 1, 2009 and July 15, 2009 and received by July 22, 2009. PRIZES & CORRESPONDING MANUFACTURERS SUGGESTED RETAIL PRICE (“MSRP”): One (1) Grand Prize: A “One-of-a-kind Custom Softail Chopper” (MSRP: $20,125.00) plus a 2 day/1 night trip for winner only to Kansas City, Missouri (ARV:$1,300). ARV of Grand Prize: $21,425.00. One Hundred (100) Second Prizes: A set consisting of: one (1) Black Cat® T-shirt (ARV: $20.00) and one (1) Black Cat® Hat (ARV: $20.00). Total ARV of Second Prize: $40.00 each. Maximum ARV of all prizes: $25,425.00. Limit: one (1) prize per person or household. Estimated number of participating retailers: 1,000. Odds of winning are dependent on the number of eligible entries received, estimated at 1:29,777 for a Grand Prize or 1:298 for a Second Prize. Grand Prize winner will need to provide proper documentation including but not limited to a valid U.S. driver’s license and proof of insurance (if applicable in winner’s state of residence) which must be in good standing issued in his/her state of residency within 30 days of prize notification or prize will be forfeited. Grand Prize winner will also be responsible for: title, tags, registration fees, federal, state, local and income taxes associated with winning and taking possession of the prize. If Grand Prize winner fails to provide such proof of possessing a valid U.S. driver’s license (if applicable in winner’s state of primary residence) and appropriate insurance or other applicable documents, the prize will be forfeited. Grand Prize Winner will be required to personally take possession of the customized chopper and will be required to present proper documentation. Should the Grand Prize Winner reside within 150 mile radius of Lone Jack Missouri, he/she will be required to take possession of the customized chopper within 30 days of prize confirmation.Travel dates will be on a mutually agreeable date determined by the winner and builder and is subject to availability and certain restrictions will apply. Trip includes airfare from winner’s residence to Kansas City, Missouri, hotel accommodations for one (1) night, and $100.00 to allocate towards gas to drive the chopper back to winner’s residence. All meals, ground transportation (other than as noted), taxes, gratuities, incidentals, upgrades, service charges or other expenses not specified herein are not included and are the winner’s sole responsibility. Any extra nights’ stay and any additional costs associated with the extended stay are the Grand Prize Winner’s sole responsibility. Trip may only be used in connection with the customized chopper and cannot be used separately. Should the winner decide to fly back to his/her hometown in lieu of driving the chopper, winner will be responsible for making the necessary arrangements to transport chopper to winner’s address at his or her expense. Any other incidental expenses or dealer installed or other customized options or travel expenses associated with picking up of the customize chopper in Lone Jack Missouri are not included and are the Grand Prize winner’s sole responsibility. Grand Prize winner shall bear all risk of loss or damage to the customized chopper after it has been picked-up by the winner. Grand Prize winner acknowledges that the Sponsor and all other businesses concerned with this Sweepstakes and their agents do not make, nor in any manner are responsible for any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of prize except that the prize is awarded as is and without any warranty. Should the Grand Prize Winner reside outside the 150 mile radius of Lone Jack Missouri, Sponsor will provide travel arrangements for winner. WINNER SELECTION/NOTIFICATION: Potential winners will be determined in a random drawing from all eligible entries received during the Sweepstakes Entry Period. Random drawing will be conducted on or about August 17, 2009 by an independent judging organization (“judges”) whose decisions are final and binding. Winners will be notified by mail. Grand Prize winner will be required to complete an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Publicity Release (Affidavit/Release”) which must be signed and returned (along with any other documentation the Sponsor may require for prize fulfillment) within ten (10) days of date printed on notification or an alternate winner will be selected in a random drawing from among all remaining non-winning eligible entries. If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who will be required to execute and return Affidavit/Release on minor’s behalf. If Affidavit/Release or any prize notification or any prize is returned as undeliverable or if a potential winner is not in compliance with these Official Rules, or cannot accept or receive prize for any reason, the corresponding prize will be awarded to an alternate winner in a separate random drawing. No substitution of any prize offered is permitted, no transfer of any prize to a third party is permitted and prize may not be redeemed for cash value, except that Sponsor (due to circumstances beyond its control), reserve the right at its sole discretion to substitute any prize for one of comparable or greater value due to unavailability. Prizes awarded within approximately 30 days after winner confirmation/verification, except in cases of delay of merchandise availability. Winners are responsible for all federal, state, local and sales and income taxes, if any. Entry constitutes permission (except where prohibited by law) to use each winner’s name, prize won, hometown, likeness, statement and photograph for publicity and advertising purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission. GENERAL: By entering, each entrant (i) accepts and agrees to be bound by these Official Rules and decisions of the Sponsor and judges, which are final and binding in all respects and (ii) agrees to release and hold harmless the Sponsor, Ventura Associates, Inc., their parent companies, subsidiaries, affiliates, retailers, advertising and promotion agencies and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each of the foregoing (collectively, the “Released Parties”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of any prize or participation in any Sweepstakes-related activity. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. The Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prizes.
